TERMS AND CONDITIONS — My Curated Party LLC

These Terms and Conditions (“Terms”) govern all bookings, rentals, experiences, products, and services provided by My Curated Party LLC (“MCP,” “we,” “our,” or “us”). By booking, purchasing, or participating in any MCP service or event, you (“client,” “customer,” “you”) agree to these Terms.
1. Booking, Deposits & Payment

A signed agreement and a non-refundable deposit are required to reserve your event date.

Deposits apply toward the total balance.

Final payment is due 7 days before the event.
-
Bookings are confirmed on a first-come, first-served basis.
-
Failure to make payments on time may result in cancellation without refund.
2. Cancellation & Rescheduling Policy

All deposits are non-refundable, regardless of the reason for cancellation.

Cancellations made more than 14 days before the event may receive a refund of payments made beyond the deposit.

Cancellations made within 14 days of the event are non-refundable in full.
-
Rescheduling may be approved based on availability.
-
MCP may cancel or reschedule due to unsafe conditions, severe weather (outdoor events), illness, equipment malfunction, or circumstances beyond our control.

If MCP cancels, you may receive a refund or credit toward a future date.
3. Event Setup & Client Responsibilities

The client must provide clear and safe access to the setup area, including nearby parking.
-
Power access must be available for machine-assisted events (standard outlet).
-
Outdoor events must be on a level, covered, or protected surface. MCP is not responsible for weather-related interruptions.

MCP is not liable for delays caused by blocked access, unsafe conditions, or venue restrictions.
-
Tables, chairs, décor, and additional rentals are available for an additional fee if not provided by the client.
4. Hosted Experiences, Equipment Use & Liability

MCP staff will operate all MCP equipment, including machines, tools, and displays.

Children must be supervised by an adult at all times.

The client assumes responsibility for the behavior of all guests.

MCP is not responsible for injuries or damages resulting from:

Failure to follow instructions
-
Rough play or unsafe behavior
-
Misuse of equipment
-

The client is responsible for the cost of repairing or replacing any MCP equipment damaged during the event.
5. Rentals, Shipping & DIY “Stuffy-To-Go” Kits
Local Rentals & Experiences
-
Equipment or displays must remain in good condition and returned (or left) undamaged.
-
Lost, stolen, or damaged items will incur replacement fees.
Shipped Orders / DIY Kits
-
Orders ship within the agreed timeline.
-
MCP is not responsible for delays caused by carriers once the package is in transit.
-
The client is responsible for providing accurate delivery information. Incorrect addresses or returned packages may incur additional shipping fees.
6. Photo & Media Policy
-
MCP may capture photos or videos of the event setup, décor, and general atmosphere for marketing purposes.
-
MCP will not post identifiable photos of children or guests without written consent.
-
If you prefer that no media whatsoever from your event be used, you must notify MCP in writing before the event date.
7. Communication & Messaging Consent (Talkroute Included)
-
By providing your phone number or email, you consent to receiving communication about your booking, including reminders, updates, and confirmations.
-
MCP uses Talkroute for business communication; calls or messages made through this system may be logged for support and quality.
-
You may opt out of promotional text messages at any time by replying “STOP.”
8. Force Majeure
MCP is not liable for delays or failure to perform due to events outside our control, including but not limited to:

Natural disasters

Severe weather
-
Power outages
-
Accidents
-
Illness
-
Equipment failure
-
Government restrictions
-
Acts of God
9. Limitation of Liability
To the fullest extent permitted by law:

MCP’s liability is limited to the amount paid for the event or service.

MCP is not liable for indirect, incidental, or consequential damages.
-
Participation in MCP events is voluntary and at your own risk.
10. Acceptance of Terms
By booking, purchasing, or participating in any MCP event, rental, or service, you acknowledge that you have read, understand, and agree to these Terms and Conditions.
