Terms of Service — My Curated Party LLC

These Terms of Service (“Terms”) govern all purchases, bookings, rentals, and services provided by My Curated Party LLC (“MCP,” “we,” “our,” or “us”). By using our website, purchasing products, or booking an event or experience with MCP, you (“client,” “customer,” or “you”) agree to these Terms.


1. Event Bookings & Payments

A non-refundable deposit is required to reserve an event date.
Final payment is due 7 days before the event.
Bookings are confirmed on a first-come, first-served basis.
Failure to make payments may result in cancellation without refund.


2. Cancellations & Rescheduling

All deposits are non-refundable.
Payments made within 14 days of the event are non-refundable.
Rescheduling may be possible depending on MCP’s availability.
MCP may cancel or reschedule due to illness, unsafe conditions, equipment failure, severe weather (for outdoor events), or circumstances beyond our control. If MCP cancels, you may choose a rescheduled date or a refund of payments made (excluding the non-refundable deposit).


3. Event Setup & Client Responsibilities

The client must provide safe, clear access to the setup area, including parking and adequate workspace.
Machine-assisted events require access to a standard electrical outlet.
Outdoor events must take place on a level, protected surface.
MCP is not responsible for delays caused by inaccessible, unsafe, or unsuitable setup areas.
Additional tables, chairs, décor, or equipment may incur extra fees if not provided by the client or venue.


4. Liability & Safety

MCP staff will operate all MCP equipment, including stuffing machines and displays.
Children must be supervised by an adult at all times.
The client is responsible for guest behavior and safety during the event.
MCP is not liable for injuries resulting from failure to follow safety instructions, running, rough play, or misuse of equipment.
The client is responsible for any damage to MCP equipment caused by guests, venue conditions, or misuse.


5. Product Purchases & Stuffy-To-Go Kits

All sales are final. We do not accept returns or exchanges unless the item arrives defective.

If your item arrives defective, damaged, or incorrect, you must contact us within 3 days of delivery with your order number, photos, and a brief description of the issue. If approved, MCP may provide a replacement item or store credit. Refunds are only issued if a replacement is not available.


6. Shipping Terms

MCP is not responsible for shipping delays caused by USPS, UPS, FedEx, or any other carrier.
MCP is not responsible for lost packages due to incorrect or incomplete addresses provided by the customer.
If a package is returned to us due to an incorrect address, additional shipping fees will be required to resend it.


7. Photo & Media Release

MCP may take photos or videos of event setups, décor, and general atmosphere for marketing purposes.
We will not post identifiable photos of children or guests without written consent.
If you prefer that no media from your event be used, you must notify MCP in writing before the event date.


8. Communication Consent (Talkroute)

By providing your phone number or email, you consent to receiving event reminders, order updates, booking confirmations, and customer service messages from MCP.
MCP uses Talkroute for phone and text communication. Standard message and data rates may apply.
You may opt out of promotional text messages at any time by replying “STOP.” Transactional messages related to your order or event may still be sent as needed.


9. Limitation of Liability

To the fullest extent permitted by law, MCP’s total liability for any claim arising out of or relating to our products or services is limited to the amount you paid for the specific product or event.
MCP is not liable for any indirect, incidental, or consequential damages.
Participation in MCP services and events is voluntary and at your own risk.


10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.


11. Agreement

By booking an event, purchasing a product, or using our website, you acknowledge that you have read, understood, and agree to these Terms of Service.

If you do not agree to these Terms, please do not use our services or place an order.
